These Terms of Use apply to the Turtle mobile application (hereby referred to as the “Application”) for mobile devices, operated by Turtle (hereby referred to as the “Service Provider”).

Acceptance of Terms

By downloading or using the Application, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Application. It is strongly recommended that you read and understand these Terms of Use before using the Application.

Use of the Application

Unauthorized copying, modification, distribution, or use of the Application, any part of the Application, or the Service Provider’s trademarks is strictly prohibited. You may not:

• Attempt to extract or reverse-engineer the source code of the Application

• Translate the Application into other languages

• Create derivative works based on the Application

All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the exclusive property of the Service Provider.

Changes to the Application

The Service Provider is committed to making the Application as useful and efficient as possible. As such, the Service Provider reserves the right to:

• Modify or update the Application at any time

• Add, remove, or change features

• Introduce fees or paid features in the future

Any charges for paid features or services will be clearly communicated to users before they apply.

User Responsibilities

The Application may store or process limited information as described in the Privacy Policy in order to provide its functionality. You are responsible for maintaining the security of your device and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your device, as doing so may:

• Compromise your device’s security

• Expose your device to malware or malicious software

• Cause the Application to malfunction or stop working

The Service Provider is not responsible for issues resulting from modified or insecure devices.

Third-Party Services

The Application may rely on third-party services to support its functionality. These services are governed by their own terms and conditions. The Service Provider is not responsible for the terms, policies, or actions of third-party service providers.

Internet and Data Usage

Certain features of the Application require an active internet connection. This may be provided via Wi-Fi or a mobile network. The Service Provider cannot be held responsible if the Application does not function fully due to:

• Lack of internet connectivity

• Network interruptions

• Exhausted data allowances

If you use the Application over a mobile network, you may incur data charges from your mobile provider. You are solely responsible for any such charges, including roaming fees if applicable. If you are not the bill payer for the device, you are assumed to have permission from the bill payer to use the Application.

Limitation of Liability

While the Service Provider makes reasonable efforts to ensure that the Application is accurate, reliable, and up to date, the Application is provided “AS IS”. The Service Provider accepts no liability for any direct or indirect loss or damage resulting from:

• Your reliance on the Application

• Inability to access or use the Application

• Errors, interruptions, or inaccuracies

Use of the Application is at your own risk.

Updates and Termination

The Service Provider may update the Application from time to time. Continued use of the Application may require you to download and install updates. The Service Provider does not guarantee that the Application will always be available, compatible with all devices, or maintained indefinitely. The Service Provider reserves the right to discontinue the Application or terminate access at any time without notice. Upon termination:

• Your rights under these Terms will end

• You must stop using the Application

• You must delete the Application from your device if required
